City of Helena Update on Immigration Enforcement Resolution
HELENA, Mont. – On March 10, 2026, the City of Helena received a letter from the Attorney General’s Office of the State of Montana outlining an opinion that the City’s recently adopted “Resolution No. 21062: A Resolution Memorializing City of Helena Policy When Federal Immigration Enforcement Actions Are Present Within City Limits,” violates state law, specifically MCA § 2-1-602, and requests the city provide explanation of how it complies with the law, as well as requesting the City Commission rescind portions of the Resolution.
The City has engaged with outside counsel Natasha Jones of Boone Karlberg in Missoula. City staff are complying with the Attorney General’s requests by providing additional explanations and relevant public documents.
The special meeting was called for by the Mayor, pursuant to Article 2, Section 3 of the City Commission bylaws to discuss this issue. Meeting details are forthcoming.
